Terms & Conditions

Last updated: 24 May 2026. These Terms govern your use of TrueBlue Compliance.

1. Agreement to terms

By creating an account, subscribing to a plan, downloading a document, or using the TrueBlue AI chatbot you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service. These Terms form a binding contract between you and TrueBlue Compliance (ABN [ABN]).

2. Description of service

TrueBlue Compliance provides Australian early childhood education and care services with: (a) a library of pre-filled compliance document templates aligned to the Education and Care Services National Law, the National Regulations and the National Quality Framework; (b) an AI-powered compliance chatbot ("TrueBlue AI"); and (c) ongoing legislative update notifications.

Documents are templates only and do not constitute legal advice or compliance advice. You are responsible for reviewing and adapting each document to your service's specific operations, and for verifying its suitability with your regulatory authority.

3. Subscription, free trial & billing

All plans begin with a free trial (7 days). A payment method is required to start the trial. If you do not cancel before the trial ends, your subscription converts automatically to a paid plan on the cycle you selected (quarterly or yearly).

Subscription terms by cycle:

  • Quarterly — minimum 3 months from conversion, then renews each quarter until cancelled.
  • Yearly — minimum 12 months from conversion, then renews each year until cancelled.

Cancellation takes effect at the end of the current billing period. Access continues until that date. Outside of your rights under the Australian Consumer Law (see section 8 — Refunds & consumer guarantees), fees already paid for the current billing period are non-refundable. Prices are in Australian dollars. TrueBlue Compliance is GST exempt.

3a. Refund Policy

Quarterly subscriptions: A full refund is available within 7 days of your initial subscription payment if you have not downloaded any documents. No refund is available after 7 days or after any document has been downloaded.

Annual subscriptions: A full refund is available within 14 days of your initial subscription payment if you have not downloaded any documents. After 14 days, a pro-rata refund may be issued at TrueBlue's discretion for the unused portion of the subscription term.

Refund requests must be submitted to hello@truebluecompliance.com.au with your account email and reason for the request. Refunds will be processed within 5–10 business days to the original payment method.

TrueBlue reserves the right to refuse a refund where there is evidence of document misuse or a pattern of subscription and cancellation.

4. Acceptable use

You may use TrueBlue Compliance only for one (1) approved service per subscription. You must not:

  • Share, sell, sublicense or transfer your login credentials.
  • Redistribute, resell or publish documents (in whole or in part) outside your subscribing service.
  • Use the platform to provide consulting or template services to third parties.
  • Reverse engineer, scrape or systematically extract content.
  • Use the AI chatbot to generate misleading, defamatory, unlawful, or harmful content.

5. Intellectual property

All policies, SOPs, registers, HR templates, written materials, software, branding and AI prompts remain the exclusive property of TrueBlue Compliance. Upon active subscription you receive a limited, non-exclusive, non-transferable licence to use the documents internally within your subscribing service. The licence ends when your subscription ends; you must cease using and destroy or archive the documents thereafter (subject to record-keeping obligations under the National Law).

6. Disclaimer

The documents, AI chatbot responses, articles and any other content provided by TrueBlue Compliance are general information and templates only. They are not legal advice, compliance advice, financial advice or migration advice. The TrueBlue AI chatbot may produce responses that are inaccurate, incomplete, or not reflective of the most recent legislative changes.

TrueBlue Compliance is not a law firm, registered legal practitioner, registered migration agent, or licensed financial adviser. We do not guarantee that any document or chatbot response will result in regulatory compliance, a particular assessment & rating outcome, or any other regulatory result. You must verify critical compliance obligations with your state or territory regulatory authority or a qualified professional.

7. Limitation of liability

To the maximum extent permitted by law, TrueBlue Compliance's total aggregate liability to you (whether in contract, tort, negligence, statute or otherwise) arising out of or in connection with the service is limited to the total fees paid by you to TrueBlue Compliance in the three (3) months immediately preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or punitive damages, including loss of profits, regulatory penalties, loss of reputation or loss of data. Nothing in these Terms excludes any non-excludable consumer guarantee under the Australian Consumer Law.

8. Refunds & Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms limits or excludes those consumer guarantees.

Your consumer guarantee rights. Under the ACL, our services must be:

  • provided with due care and skill;
  • fit for any purpose we agreed to achieve, or that you made known to us; and
  • delivered within a reasonable time.

Documents and other digital content supplied as part of your subscription must also be of acceptable quality, match their description, and be fit for the purpose for which products of that kind are commonly supplied.

Major failure. If there is a major failure with the service (for example, the service is substantially unfit for its common purpose, or significantly different from its description), you are entitled to:

  • cancel your subscription and obtain a refund of fees paid for the unused portion of your current billing period and any unusable past period; or
  • keep the subscription and seek compensation for any drop in value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage caused by the failure.

Non-major problems. If the problem is not major, we will remedy the failure within a reasonable time — for example by re-supplying or correcting an affected document, fixing a defect in the platform, or providing a partial refund or service credit at our discretion. If we fail to do so within a reasonable time, you may cancel your subscription and recover any reasonable fees paid for the unused portion.

Our discretionary refund policy (in addition to the ACL). In addition to your ACL rights, we will:

  • not charge you anything if you cancel before your free trial ends;
  • provide a full refund of your most recent quarterly or annual payment if you cancel within 14 days of your first paid charge and have not downloaded more than five (5) documents;
  • refund duplicate charges, accidental renewals you flag to us within 14 days of the charge, and charges processed after a valid cancellation; and
  • consider other refund requests on a case-by-case basis acting reasonably and in good faith.

What is not refundable. Outside of your ACL rights and the discretionary policy above, fees for completed billing periods, partial-period usage, and changes of mind after substantial use of the platform are not refundable.

How to request a refund. Email info@truebluecompliance.com.au with your account email, the charge date, and a brief description of the issue. We aim to respond within 5 business days and to action approved refunds within 10 business days to your original payment method.

9. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and TrueBlue Compliance submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be notified to you by email at least 14 days before they take effect. Continued use after that period constitutes acceptance.
